Solving the problem caused by the shareholding or the presence of faculty members in the board of directors of companies in the process of issuing a qualification certificate
Following the correspondence of the vice president of science with the head of the program and budget organization, the problem was resolved for issuing certificates requested by knowledge-based companies that are university faculty members, shareholders or members of their board of directors.
According to the report of the Communication and Information Center in the Vice Presidency of Science, Technology and Knowledge-Based Economy, Ruhollah Dehghani in this letter pointed out the problem of some knowledge-based companies, which are subject to the law in referring to legal units and determining the qualification and ranking in the program and budget organization. The intervention of government employees was considered prohibited and the request for issuing their certificates remained ineffective.
In this letter, it was pointed out that based on Article (6) of the Executive Regulations of Clause (b) of Article (1) of the Knowledge-Based Production Jump Law approved by the Council of Ministers, to use the research capacity of faculty members in the production of strategic items and knowledge-based products. In line with knowledge-based activities, executive bodies can sign contracts with companies that are faculty members, shareholders, and board members, and these companies are subject to the prohibitions of clause (b) of article (19) of the regulation on classification and recognition of competence for contractors and Note (2) of Clause (b) of Article 6 of the Regulations are not consultants.
In this letter, to speed up the issuance of requested certificates of such knowledge-based companies, necessary arrangements were made especially in the field of recognition of contracting and consulting qualifications. Also, according to the relevant regulations and instructions for the implementation of the executive regulations of Clause (b) of Article (1) of the Knowledge Base Production Jump Law was revised and communicated to the general departments and other relevant institutions.
